Terms of Service

These Terms of Service (the “Terms”) form a binding legal agreement between you and Discovery Sales LLC, a Pennsylvania limited liability company doing business as The Longevity Edge (“The Longevity Edge,” “we,” “us,” or “our”), governing your use of thelongevityedge.com (the “Site”) and your purchase of any products from us.

If you do not agree, do not use the Site and do not purchase our products.

1. About us and how to contact us

The Longevity Edge is a direct-to-consumer dietary supplement brand founded by Dr. David (“Dr. Dave”) and operated by Discovery Sales LLC, a Pennsylvania limited liability company.

2. Acceptance of these terms

You accept these Terms in any of the following ways: (a) by using the Site, (b) by creating an account, (c) by placing an order, or (d) by clicking a box that says you agree.

We may change these Terms at any time. When we do, we'll update the “Last Updated” date at the top and, for material changes, post a notice on the Site for at least 30 days. Your continued use after the change takes effect means you accept the updated Terms. If you don't agree, stop using the Site.

3. Eligibility

To use the Site or to purchase from us you must:

• Be at least 18 years old (or the age of majority where you live, if higher)
• Be capable of forming a binding contract
• Not be barred from receiving our products under U.S. law or the law of your country
• Provide accurate information when you create an account or place an order

Our products are dietary supplements intended for adults. They are not intended for use by anyone under 18.

4. Your account

To take advantage of subscriptions, saved payment methods, order history, and the rest of the features in /my-account/, you'll create an account. You are responsible for:

• Keeping your password confidential
• Everything that happens under your account, whether or not you authorized it
• Notifying us immediately at doc@thelongevityedge.com if you suspect your account has been compromised

We may suspend or terminate any account that we reasonably believe is engaged in fraud, abuse, chargebacks without basis, harassment of our staff, or any violation of these Terms.

5. Products and orders

5.1 Product information

We make every effort to display our products and their ingredients accurately. Colors, packaging, and label design may vary slightly from what's shown on the Site. The information on the Site (including in product descriptions, articles, and customer reviews) is for general information and is not medical advice. See Section 9.

5.2 Order acceptance

When you place an order, you are making an offer to buy. We accept your offer when we send the shipment confirmation email. Before that point, we may decline or limit any order for any reason, including suspected fraud, pricing or stock errors, restrictions on the products in your area, or any other reason we deem appropriate. If we decline an order after charging you, we will refund the full amount.

5.3 Pricing and availability

All prices are listed in U.S. dollars and exclude any applicable sales tax, duties, or shipping charges, which are calculated at checkout. Prices and product availability are subject to change at any time without notice. If we discover an obvious pricing error after you order, we reserve the right to cancel the order and refund you in full.

5.4 Promotional codes and discounts

Promotional codes are limited to one per order unless stated otherwise, may not be combined with other offers, have no cash value, and may expire or be revoked at any time. Discount eligibility may be revoked if we determine the code is being misused.

6. Payment

We accept the credit and debit cards listed at checkout. All payments are processed by Authorize.net. You authorize us (through Authorize.net) to charge the payment method you provide for the total order amount, including taxes and shipping.

7. Subscriptions (“Subscribe & Save”)

Many of our products are available on a recurring subscription that delivers automatically at the interval you choose.

By starting a subscription, you authorize us to automatically charge the saved payment method on your account at the recurring interval until you cancel. You will receive an order confirmation for each shipment.

You can pause, skip, change the frequency of, change the payment method on, or cancel any subscription at any time from /my-account/subscriptions/. Changes must be made before the next renewal date to apply to that shipment.

If a subscription payment fails (expired card, insufficient funds, fraud flag), we will retry the charge and send you an email asking you to update the card. After several failed attempts the subscription will be cancelled automatically.

Refunds on subscription shipments are governed by our Shipping & Returns policy. In short: the 30-day money-back guarantee applies only to your first order on a given subscription, not to subsequent renewals. Renewals can always be prevented by pausing or cancelling before the next charge date.

8. Shipping and returns

Our Shipping & Returns Policy is incorporated into these Terms by reference. By placing an order you agree to those terms, including:

• Processing time, transit time, and carriers
• The $99 free shipping threshold (continental U.S.)
• The 30-day money-back guarantee (from delivery date) for new customers
• The Return Merchandise Authorization (“RMA”) process — you must contact us first
• Who pays return shipping (you for buyer's remorse, us for defective / damaged / wrong product)
• Refund processing time (5–10 business days after we receive the return)

10. Reviews, testimonials, and user content

When you submit a product review on the Site, send us a testimonial by email or social media, post about us on social media in a way that tags us, or otherwise provide content to us about your experience with our products (collectively, “User Content”), the following applies.

10.1 Your content, our license

You keep ownership of your User Content. By submitting it, you grant The Longevity Edge a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the User Content in any media and for any purpose, including in marketing, advertising, on the Site, on social media, and in emails, with attribution to you by the name or handle you used when submitting (unless you ask us in writing to remove attribution).

10.2 Your representations

By submitting User Content, you represent and warrant that:

• The content is your original work, or you have permission to share it
• It is truthful — it accurately reflects your honest experience with the product
• It does not violate anyone's rights, including privacy, publicity, or intellectual property rights
• It does not contain anything illegal, defamatory, obscene, harassing, threatening, or otherwise objectionable
• If your User Content includes a photo or likeness of anyone other than you (including children), you have obtained that person's (or their legal guardian's) written consent for the use we may make of it
• You are at least 18 years old

10.3 No medical claims

You may not submit User Content that claims our products cured, treated, prevented, or diagnosed any disease, or that compares them to prescription medication, even if you sincerely believe the claim. We may edit or remove such content to comply with FTC and FDA rules. If you want to share that kind of detail privately with Dr. Dave, email him at doc@thelongevityedge.com.

10.4 Our moderation rights

We may, but are not obligated to, monitor, edit, refuse to publish, or remove any User Content for any reason, including for compliance with these Terms or applicable law. If you'd like us to remove specific User Content you previously submitted, email doc@thelongevityedge.com and we'll honor the request.

11. Acceptable use

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates any applicable law
• Use any data-mining, robot, scraper, or similar automated tool to access the Site without our written permission
• Attempt to gain unauthorized access to any part of the Site, any account, or any system or network connected to the Site
• Introduce any virus, worm, trojan horse, or other malicious code
• Interfere with or disrupt the Site or the servers and networks connected to it
• Use the Site to harass, abuse, or harm another person, or to send unsolicited advertising
• Resell our products without our written authorization, including for export
• Reverse-engineer or copy any part of the Site to create a competing product or service
• Impersonate or attempt to impersonate The Longevity Edge, an employee, another user, or any other person

12. Intellectual property

All content on the Site — including text, graphics, logos, photographs, audio, video, the “Dr. Dave” name and likeness, product names, packaging design, the “The Longevity Edge” name and logo, and the underlying software — is owned by Discovery Sales LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may view, download, and print pages from the Site for your personal, non-commercial use. Any other use — including reproduction, redistribution, modification, or use in another website or product — requires our prior written permission.

The trademarks, logos, and service marks displayed on the Site are registered and unregistered marks of Discovery Sales LLC or third parties. Nothing in these Terms grants you a license to use any mark without our prior written permission.

13. Third-party links

The Site may contain links to third-party websites or resources. We are not responsible for the content, accuracy, or practices of any third-party site. A link is not an endorsement.

14. Disclaimer of warranties

The Site and all products are provided “as is” and “as available” with no warranties of any kind, express or implied, except as set out in our Shipping & Returns Policy (the 30-day money-back guarantee). To the fullest extent permitted by law, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses. We do not warrant that any specific result will be achieved through the use of any product.

Some jurisdictions do not allow the exclusion of certain warranties, so portions of this section may not apply to you.

15. Limitation of liability

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so portions of this section may not apply to you.

16. Arbitration agreement and class-action waiver

16.1 Mandatory binding arbitration

You and The Longevity Edge agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or any product you purchase from us — including the validity and scope of this arbitration agreement — will be resolved by binding individual arbitration, not in court.

Arbitration will be administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules (or, if AAA declines or is unavailable, by another nationally recognized arbitration provider mutually selected by the parties). The arbitration will be held in Monroe County, Pennsylvania, or, at your election, in the county where you reside, or by telephone or video conference.

The arbitrator's decision will be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

16.2 Class-action waiver

You and The Longevity Edge each waive the right to participate as a plaintiff or class member in any class action, collective action, or representative proceeding. Disputes must be brought individually. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

If a court decides that this class-action waiver is unenforceable as to any particular claim, that claim alone will be severed from arbitration and may proceed in court; all other claims remain subject to arbitration.

16.3 Exceptions

Either party may bring an individual action in small claims court for disputes within that court's jurisdiction. Either party may seek injunctive relief in court for misuse or infringement of intellectual property rights.

16.4 Opt-out right

You may opt out of this arbitration agreement by sending written notice to doc@thelongevityedge.com with the subject line “Arbitration Opt-Out” within 30 days of first accepting these Terms. The notice must include your name, mailing address, and a clear statement that you want to opt out. If you opt out, the arbitration agreement and class-action waiver will not apply to you, but the rest of these Terms (including Section 17, Governing Law) will.

17. Governing law and venue

These Terms and any dispute arising out of them are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws principles.

For any dispute that is not subject to arbitration under Section 16, you and The Longevity Edge agree to the exclusive jurisdiction and venue of the state and federal courts located in Monroe County, Pennsylvania, and you consent to personal jurisdiction in those courts.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

18. Indemnification

You agree to indemnify, defend, and hold harmless Discovery Sales LLC, its officers, members, employees, agents, and affiliates from any claim, damage, loss, liability, cost, or expense (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site, (b) any User Content you submit, (c) your violation of these Terms, or (d) your violation of any law or the rights of any third party.

19. Termination

We may suspend or terminate your access to the Site or your account at any time for any reason, including violation of these Terms. On termination, your right to use the Site ends immediately, but the sections of these Terms that by their nature should survive termination (including Sections 9, 10.1, 12, 14, 15, 16, 17, 18, and this Section) will survive.

20. Notices

We may give you notices by email to the address on your account, by SMS to the number you provide, or by posting on the Site. You give us notices by email to doc@thelongevityedge.com, or by mail to the address in Section 1.

21. Severability and no waiver

If any provision of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver of our right to enforce it later.

22. Entire agreement

These Terms, together with our Privacy Policy and our Shipping & Returns Policy, are the entire agreement between you and The Longevity Edge concerning the Site and your purchases, and supersede any prior agreement.
